MUNICIPALITY OF SOUTHWEST MIDDLESEX COMMITTEE OF ADJUSTMENT MEETING - MAY 27, 2015

CALL TO ORDER

In attendance were Chair Vance Blackmore, members Karen Aranha, Rick Cowell, John Kavelaars, John Kendall, Don McCallum, Martin Vink and Marigay Wilkins and Secretary Janneke Newitt.  Also present were planning consultant Ted Halwa of Monteith Brown.

DISCLOSURE OF PECUNIARY INTEREST

There were no disclosures of pecuniary interest.

APPLICATIONS

Consent Application B-6/2015 – 1796 Trillium Drive – R. & J. Fisher (J. Principe, applicant)  
Mr. Principe and his planning consultant Ian Seddon attended the meeting to represent the application.
There were also members of the public in the gallery.  Chair Blackmore outlined the protocol to be
followed during the consideration of the application.  Ted Halwa gave a synopsis of his May 21, 2015
planning report.  The Secretary reported that correspondence had been received from the Lower Thames Valley Conservation Authority and Middlesex County advising of no objections or concerns with the application.   There was no input from the public.  Committee members discussed the planner’s first
recommendation to increase the lands being conveyed and straighten the new property boundary.

That consent application B-6/2015 from Robert & Jaime Fisher (applicant - John Principe) for 1796 Trillium Drive be granted, subject to the following conditions:
  • That the purchaser of the lands being conveyed undertakes to include in the Agreement of Purchase and Sale to register an application consolidating the lands being conveyed with 22222 Hagerty Road, being the assigned registry office PIN on completion of the purchase and to provide the Municipality with proof of same upon registration so that the lands being conveyed are merged in the same name and title as the lands to which they are being added. 
  • That Section 50(3) of the Planning Act, R.S.O. 1990 as amended shall apply to any future transactions or conveyances on the subject lands.
  • That the owners initiate and assume if required all costs associated with the preparation of a revised assessment schedule in accordance with the Drainage Act as amended, such costs to be paid in full to the Municipality prior to submitting a registered copy of the transfer.
  • That the taxes on the subject property are paid in full
  • That the applicant’s solicitor submits an Acknowledgment and Direction duly signed by the applicant.
  • That the applicant’s solicitor submits an undertaking in a form satisfactory to the Secretary-Treasurer to register an electronic transfer of title consistent with the Acknowledgment and Direction and the decision of the Committee of Adjustment.
  • That a preliminary survey showing the lands being conveyed and the location of all buildings and structures including their setbacks from the property lines be submitted to the satisfaction of the Municipality.
  • That two copies of the reference plan are submitted to the satisfaction of the Municipality.
for the following reasons:
  • Consistency with the Provincial Policy Statement would be maintained.
  • Conformity with the County of Middlesex Official Plan would be maintained.
  • Conformity with the Southwest Middlesex Official Plan would be maintained.
  • The requirements of the Zoning By-law are capable of being satisfied.
  • The requirements of the Planning Act would be satisfied.
  • No new lot would be created.

Secretary Newitt outlined the next steps in the consent process.

Minor Variance Application A-3/2015 – 3762 Newbiggen Drive – L. & N Vos

Applicant Mr. Luke Vos attended to represent the application.  Mr. Halwa gave a synopsis of his May 21, 2015 report.   Mr. Vos enlarged on his plans for an addition to his home and how a minor variance would allow the improvements he would like to make.  Mr. Halwa initiated a discussion on condition #1 included in his recommendation.

That a decision on Minor Variance application A-3/2015 be deferred while the applicant is given an opportunity to consider the options in condition #1 as recommended by the planning consultant and respond to Southwest
Middlesex Council.

Minor Variance A-2/2015 – 26 McMaster Place – J. & J. Beam  

Mr. Beam attended the meeting to represent the application.  There were also members of the public in the gallery.  Chair Blackmore outlined the protocol to be followed during the consideration of the application.  Ted Halwa gave a synopsis of his May 21, 2015 planning report.   The Secretary reported that correspondence had been received from Middlesex County advising of no concerns with the application.   Mr. Beam stated that he needed additional height for the garage in order to accommodate both his travel trailer and his work
vehicle.  There was no input from the public.

That  Minor Variance application A-2/2015 from Jeff & Joanne Beam at 26 McMaster Place for relief from the Southwest Middlesex Zoning By-law, specifically Section 6.3.2 f) and Section 6.3.2. h), to permit a garage/shop having a maximum floor area of 115 sq. m. and a maximum height of 6.0 metres, be granted subject to the following condition:
  • That the garage/shop is constructed generally in accordance with the plans and drawings filed with the application.
for the following reasons:
  • Consistency with the Provincial Policy Statement would be maintained.
  • The intent of the County of Middlesex Official Plan and the Southwest Middlesex Official Plan would be maintained.
  • The intent of the Southwest Middlesex Zoning By-law would be maintained.
  • The variance is considered minor in the circumstances.
  • The variance is desirable for the appropriate use and development of the lands.
Carried.

Secretary Newitt outlined the next steps in the minor variance process.
